WAIVER
Acknowledgment and Assumption of Risk:
I, the undersigned, acknowledge that participating in exercise training, including but not limited to high-intensity interval training (HIIT), strength training, cardio exercises, breathwork and the use of watersports equipment, involves inherent risks. These risks include, but are not limited to, the following:
Physical Injuries: such as muscle strains, sprains, broken bones, joint injuries, cardiovascular events, and other health risks associated with intense physical activity.
Breathwork: The contradictions for participation in the breathwork are:
Severe PTSD or trauma
Pregnancy – any stage
Actively using recreational drugs
Taking any medication that alters brain chemistry like anti-anxiety, anti-depressant, ADD, OCD medications etc
Detached Retina
Glaucoma
Kidney disease
High Blood Pressure
Cardiovascular disease, including angina, previous heart attack or stroke
Diagnosis of aneurism of any kind
Uncontrolled thyroid conditions
Diabetes (any type)
Severe Asthma – for mild to moderate asthma, we can discuss but you must bring your inhaler to the session
Epilepsy
History of seizures
Prior diagnosis of bipolar disorder, schizophrenia or previous psychiatric condition
Severe psychosomatic disorders
Recent surgery, stitches or injury
Hospitalization for any psychiatric condition or emotional crisis within the last 10 years
Watersport:
I can swim at least 50m unaided
I am water confident
Equipment Malfunctions: including failure of gym equipment or improper use, leading to potential injury.
Environmental Factors: such as slipping, tripping, or falling and water based injury such as drowning
I voluntarily choose to participate in these activities and fully understand the risks involved. I agree to assume all risks of injury or harm that may result from my participation, whether caused by my own actions, the actions of others, or the condition of the premises or equipment.
Release and Waiver of Liability:
In consideration of being allowed to participate in circuit training activities at Hello Outdoors LTD, I hereby release, waive, discharge, and covenant not to sue Hello Outdoors LTD, its owners, officers, employees, trainers, agents, and representatives (collectively referred to as "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may occur as a result of my participation in the activities.
Indemnification:
I agree to indemnify and hold harmless the Released Parties from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney's fees, arising out of or related to my participation in the activities, whether caused by negligence, to the fullest extent permitted by law.
Medical Consent:
I certify that I am physically fit, have sufficiently prepared or trained for participation in the training activities, and have not been advised to refrain from such activities by a qualified medical professional. I acknowledge that it is my responsibility to consult with my physician prior to participating in any exercise program.
In the event of an emergency, I consent to receiving medical treatment that may be deemed advisable in the event of injury, accident, or illness during my participation.
Photo/Video Release:
I grant permission to Hello Outdoors LTD to use photographs, videos, or other media of my participation in circuit training activities for promotional, marketing, or educational purposes without compensation and with no further obligation.
MEMEBRSHIP TERMS AND CONDITIONS
1. Membership Agreement:
By signing up for a membership at Hello Outdoors LTD *you agree to comply with the following terms and conditions. This agreement is between the member and Hello Outdoors LTD, located at Bath House, Bath Road, Lymington SO41 3SE
2. Membership Types and Fees:
Membership Types: Sunrise Plus, Passes and PAYG
Membership Fees: Membership fees are due in advance and must be paid in full before accessing the gym. Fees may vary based on the type of membership selected. Payments will be collected via the Hello Outdoors app and will be automatically withdrawn on a monthly basis until cancellation
You must complete all waivers before attending or booking a class
3. Membership Cancellation and Freeze:
Cancellation Policy: Memberships may be cancelled at any time with NO notice period. No refunds will be issued for unused portions of the membership.
4. Gym Access and Hours of Operation:
Access: Membership grants access to the gym during regular operating hours. Members must check online to see class times and opening hours

5. Code of Conduct:
Respectful The Club: Members are expected to keep the hub and club kit tidy and clean after each use. Please use rubbish bins provided for trash, and replace kit to where it lives
Respectful Behavior: Members are expected to treat all staff, trainers, and fellow members with respect. Harassment, discrimination, or abusive behavior will not be tolerated and may result in immediate termination of membership without refund.
6. Health and Safety:
Medical Clearance: Members should consult with a healthcare provider before beginning any new exercise program. Hello Outdoors LTD is not responsible for any injury, illness, or health condition that arises from participating in gym activities.
Personal Belongings: Hello Outdoors LTD is not responsible for lost, stolen, or damaged personal belongings. Lockers are available for temporary use during your workout session.
Safety Procedures: Members must follow all safety guidelines and instructions provided by staff and trainers. Failure to adhere to safety protocols may result in injury or termination of membership.
7. Use of Facilities and Equipment:
Equipment Use: Members must use equipment properly and follow any posted instructions or staff guidance. Misuse of equipment may result in injury or damage, and members may be held responsible for repair costs.
Class Participation: Members may participate in scheduled training classes, subject to availability. Some classes may require advance booking or additional fees.
Personal Training: Personal training services are available at an additional cost. Only Hello Outdoors certified trainers are allowed to provide personal training services within the gym.
8. Waiver and Release of Liability:
Members must sign a waiver and release of liability before accessing the gym. This document acknowledges the risks associated with physical activity and releases Hello Outdoors LTD from liability for injuries or damages incurred during participation.
9. Termination of Membership:
Hello Outdoors LTD reserves the right to terminate any membership at its discretion for reasons including, but not limited to, violation of these terms and conditions, non-payment of fees, or behavior deemed inappropriate or unsafe. No refunds will be issued in the event of termination due to a member's breach of this agreement.
10. Amendments:
Hello Outdoors LTD reserves the right to modify these terms and conditions at any time. Members will be notified of significant changes in writing or via email. Continued use of the gym after changes are communicated constitutes acceptance of the new terms.
11. Governing Law:
This agreement shall be governed by the laws of the state in which Hello Outdoors LTD operates. Any disputes arising from this agreement will be subject to the exclusive jurisdiction of the courts in that state.

1. Respectful Use of Facilities
General Conduct: All visitors are expected to respect the gym facilities, equipment, staff, and fellow users. This includes following posted rules, using equipment properly, and cleaning up after use.
Equipment Use: All visitors should follow instructions for the correct use of gym equipment. Equipment should not be monopolized; members should allow others to use equipment between sets if possible.
Cleanliness: All visitors are required to wipe down equipment after use and dispose of trash in designated bins. Proper gym attire, including clean workout clothes and appropriate footwear, is mandatory.
Changing Rooms: Changing rooms should be used respectfully. Personal belongings should not be left unattended, and members should ensure they secure their belongings in lockers.
2. CCTV Usage
Purpose: CCTV cameras are installed throughout the gym for the safety and security of members, staff, and property. The purpose of CCTV is to deter crime, monitor adherence to gym policies, and assist in investigations if necessary.
Location of Cameras: CCTV cameras are placed in all public areas, including the gym floor, entrance, lobby, and hallways. Cameras will not be installed in private areas such as locker rooms, showers, or bathrooms.
Monitoring: CCTV footage is monitored by authorized personnel only. This footage is used solely for security purposes and to ensure compliance with gym policies.
Data Retention: CCTV footage will be stored securely for a period determined by the gym’s data retention policy, typically between 30 to 90 days, unless required for longer due to an ongoing investigation or legal proceedings.
Privacy: The gym respects the privacy of its members and adheres to all applicable laws regarding the use of CCTV. Footage will not be shared with unauthorized parties without the member’s consent unless required by law.
3. Crime Reporting
Immediate Threats: If any member or staff witnesses a crime in progress or any immediate threat to safety, they should report it immediately to the gym management or staff on duty. In cases of emergency, calling 911 or the local emergency services is encouraged.
Reporting Procedure: Non-emergency incidents, such as theft, vandalism, or harassment, should be reported to the gym management or front desk staff as soon as possible. Members may be asked to provide a written statement detailing the incident.
Confidentiality: Reports of criminal activity or suspicious behaviour will be treated with the utmost confidentiality. The gym will protect the identity of the reporting individual to the fullest extent possible.
Investigation: All reported incidents will be investigated promptly and thoroughly. The gym may cooperate with law enforcement authorities in the investigation of crimes.
Consequences: Members found to be involved in criminal activities or violating gym policies may face consequences, including suspension or termination of membership and referral to law enforcement.
4. Legal Compliance
Adherence to Laws: The gym will comply with all relevant laws and regulations concerning the use of CCTV, privacy, and crime reporting.
Member Awareness: This policy will be made available to all members during the membership sign-up process and will be posted in the gym. Members are expected to familiarize themselves with this policy and adhere to its guidelines.

Hello Outdoors SMS Policy
1. Purpose
The purpose of this SMS policy is to facilitate efficient and clear communication between the gym and its members. SMS messaging will be used for essential notifications, such as class updates, schedule changes, special offers, reminders, and important announcements.
2. Consent
Opt-In: Members must opt-in to receive SMS messages from the gym. Consent can be provided during the membership sign-up process or through a specific opt-in form.
Opt-Out: Members can opt-out at any time by replying with a designated keyword ("STOP") or contacting the gym directly. Upon opting out, members will no longer receive SMS communications.
3. Message Frequency
SMS messages will be limited to a reasonable frequency, typically no more than 3-5 messages per week unless urgent notifications are required (e.g., class cancellations or emergency updates).
4. Content
Relevant Information: SMS messages will include only relevant and necessary information, such as class schedules, appointment reminders, payment reminders, promotions, and urgent updates.
No Spam: Hello Outdoors LTD will not use SMS for sending unsolicited marketing messages or non-essential communications.
5. Privacy
Data Protection:
Hello Outdoors LTD will handle members' phone numbers and personal information with the utmost care, following all applicable data protection laws. Phone numbers will not be shared or sold to third parties.
Confidentiality: The content of SMS messages will be kept confidential and will only include information pertinent to the recipient.
6. Timing
SMS messages will be sent during reasonable hours, typically between 8:00 AM and 19:00 PM, to avoid unnecessary disruptions.
7. Cost
Members are informed that they may incur standard messaging rates as determined by their mobile carrier, and these costs are the responsibility of the member.

Member Responsibilities: Members are responsible for ensuring that Hello Outdoors LTD has their correct phone number and for notifying the gym of any changes.

Hello Outdoors LTD will comply with all relevant laws and regulations regarding SMS communication, including the Telephone Consumer Protection Act (TCPA) and other applicable guidelines.
